Key landlord licensing court decision expected soon

A final decision on the legal challenge to a flagship council landlord licensing scheme has been set for next Thursday. 

The Croydon Property Forum, a group of property professionals in the Croydon area, wants to overturn the local council’s proposal to introduce compulsory licensing of landlords, who from October are faced with having to pay £750 per property every five years. 

The court hearing took place next week with the decision delayed until next week. If it succeeds - following a similar legal setback for a council licensing regime in Enfield - there could be widespread repurcussions for local authority schemes of this kind.

The Croydon Advertiser says Croydon council defended its scheme in court, saying it would raise standards of accommodation and tackle alleged anti-social behaviour in the private rental sector. 

Croydon Property Forum, a not for profit company, asked the Royal Courts of Justice to grant permission for a judicial review into the scheme, which it hopes to overturn.

The argument over the legality of the scheme hinges on the scale of consultation undertaken by the authority before deciding to announce the scheme’s go-ahead.

    If the court decision comes in favour of landlords; then I'm afraid that Councils will be facing serious problems (Falling.... falling.....just like a domino) !!
